MOUNT IDA – Robert Herrington has been charged with two counts of rape, a class Y felony, in the 18th West Circuit Court.
Herrington appeared in court Friday, February 11, for a first appearance on the charge. He has been in custody in the Montgomery County Jail since late August when he was arrested after the Montgomery County Sheriff’s Office responded to a call involving a juvenile who was allegedly being subjected to a controlled substance.
The sheriff’s office released a statement in August that they received a call on August 20, at 6:36 a.m. reporting that a juvenile female was being subjected to an unknown controlled substance.
The juvenile was transported to CHI St. Vincent Hospital before being transferred to the child advocacy center. The investigation into the call and the juvenile allegedly revealed a domestic abuse issue. The evidence collected led to the arrest of Robert L. Herrington.
Herrington was initially charged with domestic battery 3rd degree, possession of drug paraphernalia and possession of a firearm by certain persons.
Judge Andy Riner sealed the court records at the request of the prosecuting attorney’s office due to the case involving a minor.
Robert Herrington is presumed innocent in all charges until proven guilty in a court of law.
